By accessing or using Film Lab Pro ("the Service," "we," "us," or "our"), you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Film Lab Pro.
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
Film Lab Pro is provided for personal and commercial creative purposes, including photography editing, portfolio work, and client projects. You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
You retain full ownership of all images and content you upload to the Service ("Your Content"). By uploading Your Content, you grant Film Lab Pro a limited, non-exclusive, royalty-free, worldwide license to store, process, display, and transmit Your Content solely for the purpose of providing and improving the Service to you. This license terminates when you delete Your Content or close your account.
You represent and warrant that: (a) you own or have the necessary rights to Your Content; (b) Your Content does not infringe any third-party intellectual property, privacy, or publicity rights; and (c) Your Content does not violate any applicable law or regulation.
We will never sell, rent, or share Your Content with third parties for advertising or commercial purposes.
Film Lab Pro offers AI-powered features including but not limited to: dynamic range extension, noise reduction, image upscaling, depth estimation, outpainting, and anamorphic generation. These features are powered by third-party AI services including Google Cloud (Gemini, Imagen, Vision AI) and other providers.
By using AI-powered features, you acknowledge and agree that:
Film Lab Pro is not responsible for outputs generated by AI systems, including any unintended alterations, artifacts, or failures in AI-processed images.
You may not upload or process content that:
We reserve the right to remove any content and terminate any account that violates this section, without notice and without liability.
The Service and its original content (excluding Your Content), features, functionality, film emulation algorithms, presets, and user interface design are and will remain the exclusive property of Film Lab Pro and its licensors. Our trademarks, trade names, and service marks may not be used in connection with any product or service without our prior written consent.
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, us, or the Service. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service immediately ceases.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT RESULTS OBTAINED FROM AI-POWERED FEATURES WILL BE ACCURATE, COMPLETE, OR RELIABLE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FILM LAB PRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR THE COST OF SUBSTITUTE SERVICES — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless Film Lab Pro and its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where feasible, by in-app notification. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Film Lab Pro regarding the Service and supersede all prior agreements and understandings.
